Please read these Terms and Conditions (“Terms”) carefully before enrolling in any course offered by Learnistry (“we,” “us,” or “our”).

By accessing our website (learnistry.academy) or enrolling in our courses, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.

1. DEFINITIONS

“Student” or “You” refers to any individual who enrolls in or accesses our courses.

“Course” refers to any educational program, training, or material offered by Learnistry, including live classes, recorded sessions, and course materials.

“Services” refers to all educational content, teaching, mentorship, and related services provided by Learnistry.

“Platform” refers to our website, communication channels (Google Meet, WhatsApp, email), and any other medium through which we deliver our services.

2. ELIGIBILITY

2.1. You must be at least 18 years old to enroll in our courses. If you are under 18, you may only enroll with parental or guardian consent.

2.2. By enrolling, you represent and warrant that:

You have the legal capacity to enter into this agreement
All information you provide is accurate and complete
You will comply with all applicable laws and regulations

3. ENROLLMENT AND PAYMENT

3.1. Course Enrollment:

Enrollment is confirmed only upon receipt of full payment or the first installment (if payment plan is approved)
Course spots are limited and allocated on a first-come, first-served basis
We reserve the right to cancel or postpone courses with less than 3 enrolled students

3.2. Pricing:

All prices are listed in USD unless otherwise specified
Prices are subject to change without notice, but changes will not affect enrollments already confirmed
Any applicable taxes (such as GST for Indian students) will be added at checkout

3.3. Payment Methods:

We accept payments via PayPal, Razorpay, and other approved payment gateways
Payment plans (installments) are available for courses priced at $149 or above, subject to approval
Failure to make scheduled installment payments may result in suspension of course access

3.4. Currency Conversion:

Prices shown in currencies other than USD are approximate
The final amount charged may vary based on exchange rates at the time of transaction
Any currency conversion fees charged by your payment provider are your responsibility

4. COURSE ACCESS AND DELIVERY

4.1. Live Classes:

Classes are conducted live via Google Meet at scheduled times
Class schedules are provided at the time of enrollment
We are not responsible for technical issues on your end (internet connectivity, device issues)

4.2. Class Recordings:

All live classes are recorded and made available to enrolled students
Recordings are accessible for 30 days after the course completion date
Recordings are for personal use only and may not be shared, distributed, or reproduced

4.3. Course Materials:

Course materials (slides, documents, resources) are provided as part of the course
Materials are for personal, non-commercial use only
Materials may not be reproduced, distributed, or sold

4.4. Attendance:

While we encourage live attendance, recordings are available if you miss a class
No refunds or credits are provided for missed classes
Students are expected to participate actively in live sessions

5. INTELLECTUAL PROPERTY

5.1. Ownership:

All course content, materials, recordings, and intellectual property remain the exclusive property of Learnistry and Reshma Shaikh
You are granted a limited, non-exclusive, non-transferable license to access course content for personal learning only

5.2. Prohibited Uses:

You may not record, screenshot, copy, reproduce, distribute, sell, or share any course content
You may not create derivative works based on our content
Violation may result in immediate termination of access without refund and legal action

5.3. Student Work:

Projects and work you create during the course remain your property
We may request permission to showcase your work as testimonials or case studies
You retain the right to refuse such requests

6. REFUND POLICY

6.1. Refund Eligibility:

Refunds are available within 2 days of the course start date (first live class)
Refunds are not available after 2 days from the first class, regardless of attendance or completion

6.2. Refund Process:

Refund requests must be submitted via email to hello@learnistry.academy
Refunds are processed within 5-7 business days
Transaction fees (if applicable) are deducted from the refund amount and borne by the student

6.3. Non-Refundable Items:

Payment processing fees
Completed courses (beyond 2-day window)
Course materials already downloaded or accessed beyond the 2-day window

7. STUDENT CONDUCT

7.1. Expected Behavior:

Treat instructors and fellow students with respect
Participate constructively in class discussions
Submit assignments and projects on time (if applicable)
Use course materials only for personal learning

7.2. Prohibited Conduct:

Harassment, discrimination, or abusive behavior toward instructors or students
Sharing course content without authorization
Disruptive behavior during live classes
Using course access for commercial purposes without permission

7.3. Consequences:

Violation of conduct rules may result in immediate removal from the course without refund
Severe violations may result in permanent ban from all Learnistry courses

8. CERTIFICATIONS

8.1. Learnistry Completion Certificates:

Awarded upon successful completion of the course
Completion is defined as attending at least 80% of live classes or watching 100% of recordings
Certificates are digital and provided via email

8.2. Third-Party Certifications (Google, HubSpot):

We provide guidance and exam preparation for external certifications
Earning these certifications requires passing the respective organization’s exams
We do not guarantee certification success
Exam fees (if any) are not included in course fees

9. DISCLAIMERS AND LIMITATIONS

9.1. No Guarantee of Results:

While we provide high-quality education, we do not guarantee specific outcomes, earnings, or job placement
Success depends on individual effort, market conditions, and other factors beyond our control

9.2. Educational Purpose:

Our courses are for educational purposes only
We do not provide professional advice (legal, financial, tax) specific to your situation
You are responsible for how you apply the knowledge gained

9.3. Third-Party Tools and Platforms:

We may reference or teach third-party tools (Google Ads, WordPress, etc.)
We are not responsible for changes, outages, or issues with these third-party services
You are responsible for complying with third-party terms of service

9.4. Technical Issues:

We strive for uninterrupted service but do not guarantee zero downtime
We are not liable for technical issues, internet outages, or platform failures
Classes missed due to our technical issues will be rescheduled

10. LIMITATION OF LIABILITY

10.1. To the fullest extent permitted by law:

Learnistry and its instructors are not liable for any indirect, incidental, consequential, or punitive damages
Our total liability is limited to the amount you paid for the specific course
We are not liable for any losses or damages resulting from your use or inability to use our services

10.2. Some jurisdictions do not allow limitations on implied warranties or liability, so some of the above may not apply to you.

11. PRIVACY AND DATA PROTECTION

11.1. Your use of our services is subject to our Privacy Policy (see separate page).

11.2. By enrolling, you consent to:

Collection and use of your personal information as described in our Privacy Policy
Communication via email, WhatsApp, or other channels regarding your enrollment
Use of anonymized data for improving our services

12. CANCELLATION AND POSTPONEMENT

12.1. By Learnistry:

We reserve the right to cancel or postpone courses due to insufficient enrollment, instructor unavailability, or other unforeseen circumstances
In case of cancellation, you will receive a full refund or credit toward a future course
We are not liable for any expenses you incur (travel, accommodation, etc.) based on course enrollment

12.2. By Student:

If you cancel before the course start date, you are eligible for a full refund minus processing fees
Cancellations after the course starts are subject to our refund policy (2-day window)

13. COMMUNICATION

13.1. By enrolling, you agree to receive:

Course-related emails (schedules, materials, updates)
Administrative communications (payment confirmations, receipts)
Occasional marketing emails about new courses (you may opt out)

13.2. All official communication will be sent to the email address you provide at enrollment.

13.3. You are responsible for keeping your contact information up to date.

14. MODIFICATIONS TO TERMS

14.1. We reserve the right to modify these Terms at any time.

14.2. Changes will be effective immediately upon posting to our website.

14.3. Your continued use of our services after changes constitutes acceptance of the modified Terms.

14.4. We will make reasonable efforts to notify you of significant changes.

15. GOVERNING LAW

15.1. These Terms are governed by the laws of India.

15.2. Any disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra, India.

15.3. If you are located outside India, you agree to these terms and jurisdiction.

16. DISPUTE RESOLUTION

16.1. Informal Resolution:

Before taking legal action, you agree to contact us at hello@learnistry.academy to resolve the dispute informally
We will attempt to resolve disputes within 30 days

16.2. Arbitration:

If informal resolution fails, disputes will be resolved through binding arbitration in Mumbai, India
Arbitration will be conducted in English

16.3. Class Action Waiver:

You agree to resolve disputes individually and waive any right to participate in class action lawsuits

17. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.

18. ENTIRE AGREEMENT

These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Learnistry regarding our services.
